Texas police sergeant Kellie Metz fired over cop car sex
A female Texas police sergeant has been fired following allegations she had sex with another officer in a patrol car — while on duty.
The alleged hookup happened while former Sgt. Kellie Metz and Deputy Patrick Byrne, then employed by the Comal County Sheriff’s Office, were parked at the Antler Cafe, a chicken fried steak joint north of San Antonio.
A witness told investigators “he heard moaning sounds like sexual gratification coming from the area of the patrol units,” San Antonio TV station KSAT reported.
The man who claims he overheard the romp while passing, David Brakhage, said he threw a rock at the patrol car, which later earned him a charge of criminal mischief, the local outlet said.
Neither Metz nor Byrne reported the rock damage to the cruiser and had turned off their body-worn cameras during the time of the alleged sexual encounter last May, internal affairs concluded.
When Metz, a supervisor with the department, was questioned about the incident in December, she told investigators she had been teaching Byrne how to conduct “felony traffic stops” and denied having sex with him.
“You see how things just aren’t looking good … now a big old can of worms are opened up? It doesn’t look good,” an investigator reportedly told Metz as she was being questioned.
Metz was later fired for not disclosing that she was romantically involved with another officer, according to media reports.
Metz later admitted she had sex with Byrne on two occasions, though she insisted the sex took place at her home in October and November 2022.
Metz had defended her decision not to disclose the nature of her relationship with Byrne, who has been on the force for just a matter of months, trying to pass it off as a passing fling.
“The two meetings were isolated meetings and there was no intention to pursue anything further,” Metz stated as her reason for not reporting her relationship with Byrne.
It’s unclear whether the department ever definitively concluded Metz and Byrne had sex while on duty, but she was terminated regardless for violating professional conduct, employee fraternization and non-use of body-worn cameras.
Byrne also separated from the department and went to work for the Somerset Police Department, from which he has also moved on.
Charges against Brakhage for the rock-throwing incident were also dropped.
